As you will already know from your studies or the non-fatal offences cheat sheet, criminal offences are made of the actus reus and mens rea. This table summarises the AR and MR of murder and attempted murder.




Murder:

Attempted murder:

Actus Reus:

D causes the death of another human being in peace time.

An action that is more than merely preparatory to causing the death of another human – essentially when there is no turning back.

Mens Rea:

Intention to kill or cause GBH (refer back to non-fatal offences cheat sheet).

Intention to kill only – biggest difference with murder offence.
